WEBSITE SERVICE TERMS AND CONDITIONS
SERVICE PROVIDED
1.1 Launchpad Hosting, hereinafter referred to as the “Service Provider,” agrees to provide website creation, hosting, and maintenance services for [Client Name], hereinafter referred to as the “Client.”
1.2 The Client agrees to pay for domain name registration and hosting services as specified in the invoice provided by the Service Provider
DOMAIN NAME AND HOSTING
2.1 The domain name will be registered in the name of the Service Provider but is acknowledged as the property of the Client.
2.2 Hosting services are provided by the Service Provider and are billed to the Client.
2.3 In the event of non-payment or cancellation, the Client has 6 months or until the next pay period, whichever comes first, to initiate the transfer of the domain name to their possession.
TRANSFER OF SITE DATA AND CONTENT
3.1 Upon termination of services, the Client has 90 days to request the transfer of their website data and content.
3.2 The Service Provider will offer reasonable assistance in transferring the website data and content to the Client or a designated third party.
OWNERSHIP AND USE OF INTELLECTUAL PROPERTY
4.1 The Client retains ownership of all intellectual property rights related to the website content and data.
4.2 The Service Provider retains the right to display the completed website in their portfolio.
DISCLAIMERS
5.1 The Service Provider makes no warranties or representations of any kind, whether expressed or implied, for the services provided.
Prohibited Use:
The Client agrees not to use the website for any illegal purposes or to host, display, upload, modify, publish, transmit, update or share any information that:
- Violates any laws, statutes, ordinances, or regulations.
- Contains pornographic, obscene, indecent, or unlawful content.
- Infringes on any intellectual property rights, including copyright, trademark, or patent rights.
- Promotes or facilitates illegal activities.
- Contains malware, viruses, or harmful code.
Right to Refuse Service:
The Service Provider reserves the right to refuse service to any individual or entity at its discretion. This includes but is not limited to cases where the potential client’s intended use of the services conflicts with the terms outlined in this Agreement or violates applicable laws or regulations.
LIMITATION OF LIABILITY
6.1 The Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to this Agreement.
GOVERNING LAW
7.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio.
TERMINATION
8.1 Either party may terminate this Agreement with written notice if the other party breaches any material term or condition.
